Terms of Service

Effective Date: April 23, 2026

Heads up: Recess is currently in pre-launch / waitlist mode. There are no paid features yet, and by signing up for the waitlist you are not creating a binding service contract — you're just telling us you'd like early access.

1. Who We Are

Recess is a family-scheduling product operated by Litoreco and a dedicated legal entity in formation (intended to be a California or Delaware LLC, to be named "Recess, LLC" or similar). In this document, "Recess," "we," "us," and "our" refer to that operating entity.

2. Acceptance

By accessing or using the Recess website at recessfamily.com, the Recess app, or by joining the waitlist, you agree to these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old and the parent or legal guardian of any children for whom you add profiles. Recess is not intended for use by children directly; all activity on the Service happens via a parent/guardian account.

4. The Waitlist

Joining the waitlist is free. It gives you no rights, refunds, or guarantees — just first-in-line notification when we open the Service in your market.

We may email you about launch dates, beta access, and product updates. You can unsubscribe at any time.

5. Future Paid Features

Recess plans to launch paid features in the future (e.g., premium carpool matching, multi-family plans). No paid features currently exist. When paid features become available, we'll publish revised Terms that govern them before charging anyone.

6. Acceptable Use

  • Use Recess for its intended purpose: coordinating your family's schedule.
  • Don't impersonate anyone, scrape our data, or reverse-engineer the Service.
  • Don't post content that is abusive, harassing, defamatory, or unlawful.
  • Don't use Recess to market or solicit other families without their consent.
  • Don't upload malware, spam, or anything that breaks the Service for others.

7. User Content

If you post content to the Recess community feed, reviews, or any shared surface, you keep ownership of it. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service. We can remove content that violates these Terms.

8. Third-Party Services

Recess integrates with third-party services (Google Calendar, Apple Calendar, camp registration providers, Supabase, Vercel, email providers, etc.). Your use of those services is governed by their own terms. We're not responsible for third-party outages or changes.

9. No Medical, Legal, or Childcare Advice

Recess surfaces information about camps, activities, and providers for your convenience. We are not a licensed childcare agency, and we do not vet or endorse providers. You are responsible for verifying any provider's safety, licensing, references, and suitability for your family.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT RECESS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SCHEDULE IT GENERATES WILL BE PERFECT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RECESS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS CAPPED AT THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS OR (B) $50.

12. Indemnification

You agree to indemnify and hold Recess harmless from claims arising out of your use of the Service, your content, or your violation of these Terms.

13. Termination

You can stop using Recess anytime by deleting your account or leaving the waitlist. We may suspend or terminate accounts that violate these Terms or create risk for the platform.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms. Material changes will be posted here with a new "Effective Date" and, where appropriate, announced via email or in-app.
